The AIRE Centre has been granted permission by the Upper Tribunal in Vargova v SSHD (UI-2023-004566). Case concerns whether in EUSS post 30/12/20 criminal conduct deport cases, a proportionality analysis is required by virtue of Article 21 of the WA & what that looks like.

Abdullah v SSHD (UI-2022-006321). UT agrees with The AIRE Centre that where deportation is contrary to EUSS rules & not justified under reg. 27 means it is “not in accordance with the law” & so any article 8 appeal succeeds. HR appeals should also be stayed to catch up with EUSS.
