The AIRE Centre has been granted permission by the Upper Tribunal in Vargova v SSHD (UI-2023-004566). Case concerns whether in EUSS post 30/12/20 criminal conduct deport cases, a proportionality analysis is required by virtue of Article 21 of the WA & what that looks like.

Abdullah v SSHD (UI-2022-006321). UT agrees with The AIRE Centre that where deportation is contrary to EUSS rules & not justified under reg. 27 means it is “not in accordance with the law” & so any article 8 appeal succeeds. HR appeals should also be stayed to catch up with EUSS.

The Court's seem to have either resigned themselves (or happily accepted) that they have no power to scrutinise what a Home Secretary considers to be “conducive to the public good” when it comes to removing citizenship from British nationals.
