Remember when they were “constitutionalists”? The constitution says they’ve got to stick to the “case or controversy” before them, and yet they went on their wild hypothetical wanderings. Some “constitutionalists.”

Remember when they were “minimalists”? Yesterday they embarked on a long policy peregrination so as to make what Gorsuch called a “ruling for the ages.” (He actually said that.) Behind the stunning pomposity, it’s miles from “minimalist.”

Good morning from New York.

When this photo was taken at the White House in July 2017, Pecker said, Trump asked him: 'How's Karen [McDougal] doing?'

Will Trump's lawyer try to undermine it on cross-ex today? Follow along to find out. 🧵

The refusal of the GOP Justices (sans ACB) to address the Trump indictment before them as they rushed to explore in arguments how to immunize him was appalling. They should address the case before them and deny immunity for it was never part of the Constitution and totally…

I was in the Oval Office with Trump when he said a WH staffer he believed leaked an embarrassing story about him should be executed.

We may want to take this line of argument from Trump’s attorney extremely seriously.

As with the three-hour argument in Trump v. Anderson, a disconcertingly precious little of the two-hour argument today was even devoted to the specific and only question presented for decision.

Frog in boiling water alert:

Who could have imagined 8 years ago that in the Trump era the Supreme Court would be considering whether a president should be above the law for assassinating opponents or ordering a military coup and that *at least* four justices might agree.

Folks, whatever the Court does, having this case heard and the idea of having immunity for a military coup taken seriously by being debated is a big victory in the information war that MAGA and allies wage alongside legal battles. Authoritarians specialize in normalizing extreme…

Something that drives me a little insane, I'll admit, is that Trump's OWN LAWYERS at his impeachment told the Senators to vote not to convict him BECAUSE he could be prosucuted if it came to that. Now they're arguing that the only way he could be prosecuted is if they convicted.

Another tie between the Trump trial and the latest Harvey Weinstein news:

We've been hearing a lot of the Molineux precedent for both, in witnesses against Weinstein—and for Trump, in significant pretrial rulings on the 'Access Hollywood' tape and sex-abuse claims. 🔽
