Jess There is no ethical conundrum & apply the same rules if an intoxicated person assaulted you in the street & legal experts, please correct me if this it wrong. File a police complaint, charges laid, is the courts who decide guilty vs not & capacity etc.?

If people go out get plastered end up needing medical assistance as a result; then assault the HCP who is trying to help..
They should be charged with assault.
I would be inclined to request detox /counselling for a depressed individual tho.

Jess Looks pretty unanimous. The substitution method of solving hypotheticals is good: e.g RTC examples above. Consider: “Risk of the job” of a HCW assault by an intoxicated patient is equivalent to victim blaming a person who got sexually assaulted for wearing “seductive attire”.

Jess What are the ethics of someone being charged with DWI? Or sexual assault if they’ve had 2-3 drinks? Same question. Intoxication is NOT a free pass for bad behavior.

Nobody’s occupation should “ just write it off as “risk of the job””! You do assume more risk of being assaulted in certain jobs but it is still assault and should be prosecuted as such

Findlay Ferguson Danny Hill Another weak sentence. I get the impression from recent Australian cases that there is more concern about clinician codes of conduct than their safety or the deterrence of violent behaviour. Assault in general is poorly punished, against emergency workers even more so.
