The Federal Court Rules Committee is considering amending the certification test to include the predominance and superiority language in Ontario's amended CPA. Is any other Cdn jurisdiction considering the same amendment? Grateful for any info, whether confirmed or rumored.

This will be an interesting one. Lots of challenges for the school boards in establishing liability, particularly if the cause of action is negligence. Would be interested to see the Statements of Claim if anyone has them.
