The vast majority of antitrust lawsuits fail and the NCAA has showed no worry for spending massive dollar amounts on lawyers. If NCAA is making decisions based on fear of being sued for regulating NIL, it should close shop and let conferences take over. papers.ssrn.com/sol3/papers.cf….

Which court ruling would prevent the NCAA from regulating NIL?

O'Bannon v. NCAA would not.

NCAA v. Alston, which wasn't about NIL (it was about colleges agreeing to not pay athletes for education-related costs), would not.

I don't see the precedent. NCAA just failed to act.

I still think NIL is a good thing because to deny any group of Americans—be they college athletes, singers, actors or influencers—their right of publicity (which is what NIL is) is to deprive them of a right. It’s not athletes’ fault the NCAA can’t figure out how to regulate it.

Nearly 5 years ago, Russell Westbrook and a Jazz fan had an exchange during a game that led to the fan's permanent ban from Jazz games--and the fan suing Westbrook and the Jazz for defamation.
