The way in which most people encounter the effect of legislation is not through the court process but through its out of court application. Therefore understanding how institutions apply legislation, and how the public understand it matters enormously.

And a key point which should be inherent in the understanding of legislation but is often ignored (sometimes, irritatingly, by lawyers including academic lawyers).
Legislation does not depend on the courts.
Legislation is applied without the courts.

Legislation does not exist in isolation. It is introduced against a background of existing law, usually to make changes. But it is also introduced against a background of existing practices - & awareness of those practices and the institutions who will have to implement matters.

policy making and legislating is a serious business. Legislative scrutiny should be a serious business. Each part of the process deserves to be treated seriously. And in legislative reform that involves considering implementation and institutional capabilities to implement.

2023 Approvals = 4,418 vs 5,061 in 2022. This is a 13% decrease. 2023 Starts = 4,360 vs 5,989 in 2022. A 27% decrease. 2023 Completions = 6,946 vs 8,434 in 2022. A 18% decrease.
