By concentrating on Criminal Law, I sometimes wonder if I've missed out on other areas of law addressing the really big philosophical questions in life.

🚗as weapon.
The Court of Appeal decision of Grant [2021] shows the courts are willing to accept that driving a car at a pedestrian at 18mph can provide evidence of an intent to kill, as required to prove attempted murder (argument of defence counsel is rejected by the court):

Old motor murder (+ attempted murder) case (not sure how I missed this at the time). Sentenced to life imprisonment with a minimum term of 25 years (upheld on appeal).

Disqualification for life.

Includes suggested guidance on topping up, special reasons, and lifetime bans.

It's rather brief. Meatier guidance needed, IMHO.Consultation open 'til 22nd May!

Despite the Sentencing Code, the job of judges is still fiendishly complicated.
As well as increasing max for this offence to life, the PCSCA 2022 also increased time served for certain offences to 2/3 from 1/2. The increase to life makes s.1 RTA 1988 one such offence.

A tragic case, but if the expert witnesses for Crown & defence agreed he was suffering from diminished responsibility, according to cases such as Brennan [2014] EWCA Crim 2387 the judge should have withdrawn murder from the jury anyway.

Restrictions on new drivers could help save lives, public health officials have said.

A graduated driving licence could see restrictions on young people, such as how many passengers they can have.
