New Commissioner for Human Rights Michael O'Flaherty BCL '80 recently set out his priorities for his 6-year mandate.

He told us about these last month, in a staff seminar as one of our Adjunct Professors. Last week he met ECHR CEDH President Síofra O’Leary BCL '89.

Poland's new govt takes an important step toward restoring judicial independence. If the puppet president vetoes it, Europe should understand that the rule of law is still under threat because the prior government entrenched itself to resist democratic change.

Acc to my data = total of 43 preliminary ruling requests (with 3 pending) originating from *lawful* Polish courts raising systemic issues. Total doesn't include PR requests from PiS fake 'judges' which cannot be considered 'courts' notwithstanding lenient ECJ stance

Latest ECJ PR cases re in Poland:
C-114/23 et al: All 4 requests held inadmissible
C‑647/21 & C‑648/21: For AG Collins, rules that permit non-consensual transfer of judges & unfettered removal of cases ex officio are not compatible with EU law. Important ruling to come

Convincing critique of AG Pikamäe's opinion re the first ever CJEU case re state of the & independence of the judiciary in (another preliminary ruling case and not a Comm infringement action one may note)

EU interregnum year is always best time for would-be autocrats to engage in systemic constitutional capture and create irreversible facts on the ground/establish mafia state. By the time, Commission and Council might eventually think of doing something, it is too late

Interesting & as it happens, this is exactly what associations of judges & prosecutors have requested the EU General Court to recognise re issues in situation where systemic deficiencies have already been recognised by EU institutions, incl. CJEU itself The Good Lobby Profs

Huge. The court's flexible approach to standing for associations will have massive repercussion for climate cases in future (many more NGO cases). The court specifically recognises the 'importance of associations to litigate issues of climate change on behalf of affected persons'

🚨On an audio released today by her ex-husband, former justice minister Judit Varga clearly details how Hungary's public institutions charged with investigating & prosecuting corruption are under political influence.

The European Commission must take immediate action.
