I’m overwhelmed by all the love and support on here for my professional news. Thanks to you all, I look forward to continuing to advocate for all my clients (with the advantage of being one row further forward in court)

We would advise all families of disabled children who have EOTAS, and who would otherwise qualify for FSMs, to get in touch with their local authority to ask that urgent arrangements are now made, so that they are treated the same as families whose children can attend school.

We are delighted that the Secretary of State for Education has conceded that the current position regarding children with EOTAS accessing Free School Meals (FSMs) is potentially discriminatory and is taking urgent steps to rectify the position.

WE DID IT!

In case you missed the good news, @damianhinds has agreed to update government guidance in order to stop 164,000 eligible disabled children from missing out on their free school meals.

Very helpful explainer of one of the more controversial proposals in the SEND improvement plan. It seems the ‘tailored list’ is simply an individualised local offer at this point - which is inoffensive, but as always implementation will be key

Zero connection between EHC Plans and ordinary school transport in law. What requires councils to pay school transport is educating children at a distance from home (because there’s insufficient local provision). Calling EHC Plans a ‘golden ticket’ is pernicious and wrong

We're still without a Minister for Disabled People...

This is the longest gap without a minister in post in the last 30 years.

What kind of message does the government thinks this sends to the country's 16 million disabled people?

Today I spoke with an SEND officer about an EHCP that was under assessment. My recommendation was that all staff working with an autistic child should have autism specific training (not 1hr inset type). She looked horrified. If you want quality mainstream ed then train staff 🤷‍♀️

A great outcome for our client - and a demonstration that social care decisions can be challenged successfully by judicial review

Also notable - permission refused on the papers on basis claim was unarguable - but granted at renewal hearing, and claim allowed on three grounds

Great work on this case by Emily Church Irwin Mitchell & Steve Broach of 39 Essex Public Law

Emily said: “A proper consultation should be undertaken before any major decision that will have a significant impact on the lives of vulnerable people”

Shout out to all those this week who recognise that risk isn’t always negative or something to be mitigated against. One of the biggest risks to people who draw on support is the concept of risk itself. We safeguard people’s rights not people.

NEW: 41% of older children in care in England now live in care-less accommodation.

When we were in the High Court in 2022, government (backed by care review's interim report) stressed that 'some' children in care aged 16 & 17 are 'ready for independence'.

*41% is not some*

This is important work by Prof Clements and colleagues. FII is extremely rare, and the unfounded suggestion of it is highly damaging to parents and children. More care needed by professionals, to ensure legitimate safeguarding concerns are those that get investigated
