At the very very least, no lawyer taking the caselaw seriously should say that doing what Mr Jones did in Croft v Royal Mail is undoubtedly unlawful discrimination. Not least because Croft lost that case and the court conclusively held that it was not unlawful discrimination.

Worse, Robin does not mention the caselaw of senior courts which do set binding precedent that directly contradicts this position except to claim that these decisions are all obiter comments and so not binding. Even if that were true, it’s more authority than Robin can produce.
