First up, Josh Turner, for the State of Idaho: state licensing laws are not preempted by federal law just because the federal government wants to regulate abortion.

Sotomayor: Idaho misunderstands federal supremacy. If Idaho mandated an unusual treatment for diabetics outside the standard of care to stabilize a patient, federal law would say 'no.' This is all about basic emergency care. The state can't override objective standards of care.

Justice Barrett asking (rather skeptically) whether differences in medical good faith judgment could result in a prosecution if a doctor was unsure if a woman was likely to die versus substantial medical harm.

Idaho: that's a matter of prosecutorial discretion

Within minutes of oral arguments, Justices Kagan, Sotomayor and Jackson make the case that federal law protects emergency abortion and pregnant people need access to this life-saving care.

This is what we mean when we say we need fair, unbiased judges who will uphold our rights.
