Good example of corporate defense bar and academic allies deceptively sowing doubt about FTC authority to ban non-competes. The conservative Burger Court said in 1986 that FTC Act is broader than Sherman Act; this is not confined to the Warren Court in the 1960s.

@ftc's final rule banning non-competes also bans Training Repayment Agreement Provisions (TRAPs) that 'function to prevent a worker from seeking or accepting other work or starting a business after the employment associated with the TRAP.'

Two weeks ago at a private antitrust event, a Chamber of Commerce official said they would sue to block the noncompete ban. All politicians who get Chamber support should be asked whether they support businesses depriving their workers of economic liberty.
