With yesterday's Title II vote, the The FCC has re-asserted its authority over broadband. However, it has expressly left a role for states, so New York's program, similar ones in other states, & state broadband laws such as California's strong law, can stay in place.

The court found that the Communications Act reserves a role for states to protect broadband consumers, and that the previous The FCC's rejection of its own broadband authority did NOT prevent states from implementing their own broadband policies.

Today’s FCC vote restoring net neutrality is a HUGE step toward an open internet. The minority commissioners’ arguments against it are anti-citizen, anti-consumer, anti-public safety, and radically inimical to the kind of open internet needed to replenish our democracy.
