2024: I’m mad about something and I’m going to take it out on the local Jew.

Most years: I’m mad about something and I’m going to take it out on the local Jew.

'It's pretty clear what's going on: students who feel impotence in the face of the horrors in Gaza are taking it out on a symbolic representative, i.e., their Jewish Dean. There's a word for that, and it's not one that reflects well on them.' -Brian Leiter https://universeodon.com/@BrianLeiter leiterlawschool.typepad.com/leiter/2024/04…

Excellent thread.
The 1st Amendment claim of a right to disrupt a private or non-public backyard party is plainly meritless and embarrassing.

This thread is right. The Manhattan DA case keeps claiming the case is about election interference, but it isn't. It's about a cover-up of a federal crime (FECA).

Does NY state have an interest in uncovering federal crimes that counts for 175.15's 'intent to defraud'?

Thread: Here's what still troubles me about the New York case.

Everyone says the case is not about hush money, it's really about election interference and depriving the voters of important information. But how does that theory work, exactly? 1/

Erwin and Catherine are great people with a much deeper reservoir of patience than I have. As I’ve said to my students, it’s important to foster a sense of community even with big disagreements and I worry we’ve lost this ability.

It bears repeating:
Textualism is a method of statutory interpretation, not a (real or practiced) method of constitutional interpretation.

Textualism rejects legislative history and contextual purposes.

Originalism relies on drafting history, ratification debates, and context.

I confess that I regard those who eat cuttlefish and octopus the way I think of those who would eat dogs.

I know it’s hypocritical & species-ist… I eat fish. At least I resist the urge to protest. Maybe I shouldn’t?

This was the controversial foul call at the end of the women’s semi-final.

Apparently the critics of the refs think the last 30 seconds of a basketball game should be tackle football.
If you want refs to bend/ignore rules in order to manufacture drama, watch pro wrestling.

If you tell yourself a story in which you’re the hero…
Try not to make anyone else the villain.

(At least make them the anti-heroes).

An Israeli Jewish family offering dates to Palestinian Muslim worshippers outside Damascus Gate in Jerusalem during an evening in Ramadan.

A small yet profoundly meaningful gesture in a time dominated by hatred, dehumanization, and calls for revenge from both sides.

Thinking about our Palestinian, Jewish, Arab, and Israeli students, and what it means to feel fear, isolation, and exclusion in your own community during a time of heartbreak. Our hearts are big enough for all of them.
