Several members of the Supreme Court have made a point recently of emphasizing how well the justices get along on the divided court. But what really matters is what the court does or doesn’t do, Linda Greenhouse writes.

If you sincerely believed that abortion was murder you'd never compromise at x weeks. You'd be utterly unyielding. If, on the other hand, your aim was to restore traditional gender relations, then you'd behave exactly like the GOP is now.

I'm so excited to see how this evolves! It's wonderful to have data on an important part of the judicial/CJ system - the judicial workforce & how judges treat their staff.

And also: sunshine is the best disinfectant.

Much has been written about 'white privilege,' 'male privilege,' etc.
Starting to realize how much 'blue state' privilege I have. Much of America thinks New York is a hellhole or whatever, but here my life & body are protected in a way they wouldn't be if I lived in TX, FL, AZ.

Harvard Law Review has put together a list of nationwide injunctions issued by courts against the federal government over the past 60 years (some from a FOIA request and the rest from independent research).

In no state has the FAFSA submission rate equaled or increased over last year. In no state has the rate decreased by less than 25%. It hurts to think of how this will compound losses in diversity from the SCOTUS decision.

I guess the verdict is in, but I really don’t understand why Senators have to be publicly obtuse about this. How is it possible they don’t understand the issue after witnessing the aftermath of RBG’s death in office and the end of constitutionally guaranteed reproductive rights?

Josh Marshall Agreed. I think law professors often have a particular blind spot. Over 99% of legal questions aren’t really politically contested, and most lawyers will never touch the really partisan cases. So every prof’s job is to teach their students to argue like politics doesn’t exist.

getting people excited about a potential replacement actually worked pretty well in creating momentum in pressuring Breyer (ok, yeah, I know...)

it can work with Sotomayor as well

but not with a 'she alone can fix it' mentality

The problem with the Dem positioning here is that, sure, Sotomayor is great, trailblazing etc, but there are lots of amazing Latino/a and/or POC lower court judges who are outstanding

it's not Sotomayor or nothing

let people get excited about a potential replacement!
