The way that the Supreme Court framed the 'question presented' in the immunity case suggests they'll decide there is presidential immunity in *some* circumstances.

Jack Smith's brief takes that possibility seriously, persuasively arguing that *this* case should go forward.

No…

Cannon is scheduling hearings for motions filed by Trump's co-defendants but not for motions filed by him.

Her decision not to schedule hearings on Trump's motions when she had an opportunity to do so is additional evidence that she is in no hurry to proceed with Trump's trial.

Amazing stuff going on this thread, in which a top Fox anchor screenshots the 2020 Arizona call to show that it was made after 73% of the vote was counted and reply guys say “no, it just 1% counted, I remember it.”

I agree. Mandamus is unlikely to succeed at this time.

A motion for recusal is also unlikely to succeed based on the record thus far in the criminal case.

I expect Jack Smith will pursue neither avenue for now.

This is important — Judge Cannon refused to make a decision regarding Trump’s absurd Presidential Records Act arguments before the Mar-a-Lago trial begins.

By refusing to make a decision, Jack Smith has nothing to appeal.

If Cannon instructs the jury incorrectly and Trump is…

The Mar-a-Lago case remains the steepest legal challenge Trump faces.

Absolutely devastating evidence that is almost impossible for Trump to overcome.

That’s why he is trying to delay and is making absurd arguments about the Presidential Records Act.

To make this crystal clear, if trial begins and Judge Cannon makes a ruling that is legally erroneous *in the middle of the trial*, resulting in a not guilty verdict, prosecutors *cannot* appeal the verdict.

That's why Jack Smith wants a ruling before trial, so he can appeal.
