Just change your example to making $10 in interest instead of a $10 capital gain.
You pay a greater effective rate of taxation on the full $10 interest than on the gain.
No “double taxation” in either case.

Fun fact: under Brian Mulroney's PCs in the 1980s the capital gains inclusion rate was hiked from 50% to 75% -- and the overall combined corporate rate was in the low-40s versus the current rate of 26.5%.

I disagree. Certainly lots of scope for critiques of the government. And lots of possible tax changes to boost productivity that weren't adopted. But adjusting the inclusion rate to better align treatment of dividends and capital gains is not a problem.
