An appeals court in Washington D.C. will decide whether or not a case will go to trial that seeks to use an unknown clause of the 14th Amendment to strip states of their congressional representation if they disenfranchise voters. prospect.org/justice/2024-0…

What’s Section 2? Just as forgotten until recently as Section 3, it was the Reconstruction Congress’s attempt to prevent ex-Confederate states from getting the benefit of counting the freedmen as whole people for House apportionment purposes but also denying them the vote.

“I have a problem when you make an argument that with respect to a specific constitutional provision you can’t articulate to me how any plaintiff would ever have standing.”

That’s a question Judge Wilkins asked today in a 14th Am, Sec TWO (not Three) case before the DC Circuit.

Jared Pettinato But the district court (a 3 judge panel) threw the case out on standing. Essentially it said we don’t know if the plaintiff would win. Therefore, no standing.

Jared Pettinato As for the merits, he argued certain states had denied people the right to vote through various laws, such as voter ID. Now, you may violently disagree with that point. But that shouldn’t affect standing. Again, the Census didn’t even look at Section 2, let alone apply it.

Jared Pettinato Jared did everything right to get the case to the merits. He ingeniously used the APA to challenge the Census’s failure to apply Section 2. It’s uncontested they didn’t (indeed, it’s uncontested Section 2 has been ignored since 1870).

Just like Section 3 it’s still in the Constitution. It’s broad: “when the right to vote…is…in any way abridged”. But it’s never been enforced. So my buddy Jared Pettinato brought a case about it regarding the 2020 Census. Here’s a profile from 2022.
