The lawsuit was not mentioned during the meeting. The board postponed action to give its new general counsel, Cara Nicklas an opportunity to review it. Nicklas was hired during the board’s November meeting.

alleges Walters and the board violated the Administrative Procedures Act, the Equal Protection Clause of the Oklahoma and US constitutions, Title IX prohibitions on gender discrimination and the Oklahoma Parents’ Bill of Rights.

The lawsuit was filed against Walters and the State Board of Education by the Oklahoma Equality Law Center and the Oklahoma Appleseed Center for Law and Justice on behalf of a student.

The board adopted the emergency rule in September. A lawsuit was filed Thursday challenging the rule.

At its October 26 meeting, the board denied requests from two school districts to authorize changing the gender or sex designation of two students based on the emergency rule.

The State Board of Education, meanwhile, delayed action Thursday on adopting a permanent rule that prohibits local school districts from changing students' sex or gender identification on prior students' records without state board approval.
