In AD v Hackney (the Hackney Special Education Crisis) case, the Court found that the LA’s banded funding policy would not necessarily result in a breach of the s 42 CFA duty to secure special educational provision. Looks like argument for Waltham Forest special education crisis is that this LA’s policy (post cuts) will.
