As we found for our book research in LIBERATING ABORTION many of the first bans were poison control measures from the 1820s and were rarely if ever enforced. The laws in the 1860s were part of a wave of restrictions to kick Black, Native, & immigrant midwives out of medical care.

When Justice Blackmun wrote Roe he looked through history’s acceptance of abortion and learned that generally it was accepted until quickening. That is when the Supreme Court created the trimester framework legalizing abortion until viability, which was the new quickening.

What’s important to know about the context of these old laws is that pregnancy was considered such after quickening, when the pregnant person could feel fetal movement. So, what they’re considering an abortion is a later second trimester abortion by today’s standards.
