Justice Jackson: most of the allegations here, there is no plausible argument that the facts here suggest that these were official acts. Followed with taking the concern as real about future presidents being in fear of reprisal. But, wouldn't they care about future reputation?

Justice Jackson: what is being avoided is the question whether a former president can be held liable for committing a crime. Can the president be held criminally liable for committing crimes? Or is a president immune from committing crimes?

Justices seem to know that the facts in this case do not hold well for Donald Trump. Conservative Justices seem to be pursuing the notion that if the immunity defense fails, future former presidents would be subjected to the possibility of criminal prosecution from opponents.
