Peter Brent You're mixing up 2 different principles for indication of provisional measures. The risk of harm is different from the plausibility limb. You're describing the later as the former.
Peter Brent Nah, the 'irreparable harm' bit is just a 'what if?' I.e., if the whole claim turns out to be true, is there a risk that the thing we're being asked to stop will happen before we get around to deciding the case?
The 'plausibility' bit is a 'could it?', i.e. might it be true?
