If I were President Biden, I’d be seeking an OLC opinion on whether there is a statutory or constitutional basis for insisting President Biden has discretion to delay a formal finding on int’l law compliance by an aid recipient when the deadline would affect POTUS’s int’l negotiating flexibility.

Rather than cutting a “rule for the ages” from whole cloth, shouldn’t the obvious move be, “Without foreclosing the possibility that there might be some scope for an ‘official acts’ immunity from criminal prosecution, the acts alleged here fall clearly beyond that scope?”

My inclination is more often to read a SCOTUS oral argument transcript than to listen in real time, and I’m always blown away by SG Prelogar’s skills as an advocate. Her preparation and presentation are off-the-charts exceptional.
