Absolutely delighted today to see Rebecca Roiphe's kind review of my and Nora's piece on Auto Clubs in Jotwell! It's such a thoughtful and generous engagement with the article -- I'm thrilled, and deeply grateful.

I think this is right but it does raise some doubt about the claim that prosecutors are just applying the law to the facts as they would with any other suspect. 'No man is above the law' but Trump is not exactly treated like any other person and it's better to admit that.

Bruce Green explains why the allegations that Georgia prosecutor Fani Willis was in a relationship with the special prosecutor should not lead to disqualification. I do think it makes her look bad and so casts a shadow on the case. cnn.com/2024/01/24/opi…

Most legal scholarship fades into the past. But this piece by Charles Fried is still seminal, quoted by every scholar of the legal profession. He will be missed. dash.harvard.edu/handle/1/23903…

I agree with both Randall Eliason and Norm Eisen (#TryingTrump is out 4/10!) et al. This is not a disqualifying conflict. It's not really a conflict at all. But if true it is corrupt and does cast a shadow over the prosecution.

This is correct. While Wade was the beneficiary of low level corruption (like someone who gets a courtesy card from the police union), it is not a disqualifying conflict of interest. For many many more words on the subject see my piece with Bruce Green. papers.ssrn.com/sol3/papers.cf…

This exchange shows how Trump uses the court like the Chicago 7 defendants did. It's a win-win for him because either he gets to do what he wants or the judge forbids it in which case he uses the judge's reaction to convince the public how corrupt the system is.

People widely misunderstand the meaning of academic freedom. It does not mean complete insulation from and lack of accountability to the public. It ensures that disciplines can develop freely, then be subject to public consumption/critique. It's a system of checks and balances.

This is so interesting. I wrote about this evolution (somewhat incidentally) in this piece but great to have a source about its origin. The deference to the most vocal consumers in education is problematic for many reasons.

In SAPIR’s Education issue, Rebecca Roiphe observed that β€œnot only is it chic to look down on Jews, it’s also virtuous.” Amid widespread concern about antisemitism at law schools, her essay β€œThe Rise and Fall of Jews at Law Schools” is freshly important. sapirjournal.org/education/2022…

The power of professionalism. Our system depends on it. Trump acted as if there is only loyalty and political allegiance. His adversaries often do the same thing.

It was so odd that Suggs was initially represented by WilmerHale along with Adams and the campaign - a sign that they weren't planning to throw her under the bus, but regardless of their strategy she obviously needs her own lawyer.

The ethical landscape is also different because the panelists all agreed about the import of nation and enemies of the nation. So many people now divide the world into the categories oppressed and oppressor instead.

This article explains why the effort to manufacture an inclusive environment on campus by restricting speech is doomed to fail. It puts the administration in a position where it has to decide which group is more deserving of 'marginalized' status. chronicle.com/article/war-an…

This analysis of antisemitism at US law schools by Rebecca Roiphe is a must-read. β€œOne of the reasons why this new form of antisemitism is so insidious is that it is cast in proudly moral terms. Not only is it chic to look down on Jews, it’s also virtuous.” ADL JCRC of New York American Jewish Congress
