Cath #GeneralElectionNow Yes. DPA2018 states that data subjects ie people, must give EXPLICIT permission for the use of their data. It was a major shift from the nineties act which allowed IMPLICIT permission. Not opting out infers implicit permission.

Consent is not the only lawful basis for processing special category personal data. Article 9(2)(g) of the GDPR read along with Paragraph 10 of Schedule 1 to the DPA2018 probably provides a lawful basis for this processing.

This is special category (within GDPR) private health information - that an individual has tested positive for a disease. It shouldn't be shared with the police, because privacy, no consent and because it will stop people using track and trace.

EDPB now has #GDPR #fines guidance for all EEA 31. @iconews has #DPA2018 duty to estab same. 1st consulted on in 09/2020 & again in 03/2022 ico.org.uk/about-the-ico/…. In 06/2022 it peremptorily pivoted away from fines for public sector & 5 years on still no DPA2018 guidance.
