Legal analysis or just wishes? The term 'should' is used 149x in the document. In the section on 'Freely given consent' alone, 53x. In contrast, 'must', 'shall', 'have to' and 'has to' altogether occur less than 25x in the same section.

So, as I understand from today's IAPP's LinkedIn live, where the EDPB's representative spoke about recent opinion on #PayorOkay , EDPB will draft guidelines on #PayorOkay , which will dive deeper into the issue. I hope these guidelines will come rather soon.
