3/ As a result, administrators are not subject to the threat of criminal sanction if they fail to comply with the statutory notification requirements.

2/ The Supreme Court relied heavily on the distinction between administrators & officers in parts of the Insolvency Act 1986, whilst disagreeing with the Div Court's application of a functional test under s.194(3) where the statutory wording didn't suggest such an approach.
